Compliance or planning

Compliance is filing what has already happened. Accounts, returns, deadlines. Priced per year, largely commoditised, and every firm on this site's accountants shortlist does it.

Planning is changing what happens next. Structure, timing, relief, extraction, exit. Priced per project or per hour, and it is where a specialist earns multiples of their fee or costs you nothing at all.

The firms here do planning. If what you need is a return filed, you are on the wrong page and should be paying less.

Three questions before you engage

  • Is the person advising me a Chartered Tax Adviser? Ask for the individual, not the firm.
  • If HMRC opens an enquiry, is defending it inside this fee? Particularly for R&D.
  • What would you charge to review my current structure? A firm that will quote for a review is confident there is something to find.

Red flags

  • A percentage of the refund quoted before anyone has looked at the technical work.
  • R&D advice from a firm that will not put a named qualified individual on the report.
  • No mention of enquiry defence in an R&D engagement letter.
  • Advice given after a transaction has completed, presented as planning.
  • Any scheme requiring a disclosure of tax avoidance schemes number. If DOTAS is mentioned, get a second opinion from an unconnected firm.

When you do not need this

For a straightforward employed taxpayer, a single rental property, or a small company taking a salary and dividends, your accountant is the right adviser and a specialist is overkill. The planning opportunities at that level are limited and well understood.

The threshold is a transaction or a number large enough that a percentage of it exceeds the fee. A business sale, a property portfolio disposal, an incorporation, a family succession, an R&D programme of real substance. Below that, spend the money on getting the compliance right and the records clean, which is what makes the planning possible later.

An accountant prepares and files: statutory accounts, corporation tax returns, self assessments. A tax adviser plans: how a transaction should be structured, what relief is available, how to extract value from a company, what a disposal will cost and whether it can cost less. The formal marker is the CTA qualification and membership of the Chartered Institute of Taxation. Plenty of good accountants do straightforward planning. For anything involving a sale, a restructure or a large capital gain, you want someone whose whole practice is tax.
